Determination of foreign countries engaging in economic or industrial espionage in cyberspace
Form of report
Each report required by paragraph (1) shall be submitted in unclassified form but may contain a classified annex.
Imposition of sanctions
In general
50 U.S.C. 1701The President may, pursuant to the International Emergency Economic Powers Act ( et seq.), block and prohibit all transactions in all property and interests in property of each person described in paragraph (2), if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.
Persons described
A person described in this paragraph is a foreign person the President determines knowingly requests, engages in, supports, facilitates, or benefits from the significant appropriation, through economic or industrial espionage in cyberspace, of technologies or proprietary information developed by United States persons.
Exception
The authority to impose sanctions under paragraph (1) shall not include the authority to impose sanctions on the importation of goods.

Penalties
50 U.S.C. 170550 U.S.C. 1705(a)The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act () shall apply to a person that violates, attempts to violate, or conspires to violate, or causes a violation of, this subsection or a regulation prescribed under this subsection to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act [].
Rule of construction
Nothing in this section shall be construed to affect the application of any penalty or the exercise of any authority provided for under any other provision of law.

The term “knowingly”, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.
