Formula grants to States

(a)

In general

section 300x–7 of this titlesection 300x–6 of this titleFor the purpose described in subsection (b), the Secretary, acting through the Director of the Center for Mental Health Services, shall make an allotment each fiscal year for each State in an amount determined in accordance with . The Secretary shall make a grant to the State of the allotment made for the State for the fiscal year if the State submits to the Secretary an application in accordance with .

(b)

Purpose of grants

section 300x–5 of this titleA funding agreement for a grant under subsection (a) is that, subject to , the State involved will expend the grant only for the purpose of—
(1)
section 300x–1(c) of this title providing community mental health services for adults with a serious mental illness and children with a serious emotional disturbance as defined in accordance with ;
(2)
section 300x–1(a) of this title carrying out the plan submitted under by the State for the fiscal year involved;
(3)
evaluating programs and services carried out under the plan; and
(4)
planning, administration, and educational activities related to providing services under the plan.

“(a)

Review of Use of Certain Funding .—

42 U.S.C. 300xNot later than 1 year after the date of enactment of this Act [], the Secretary of Health and Human Services (referred to in this section as the ‘Secretary’), acting through the Assistant Secretary for Mental Health and Substance Use, shall conduct a review of State use of funds made available under the Community Mental Health Services Block Grant program under subpart I of part B of title XIX of the Public Health Service Act ( et seq.) (referred to in this section as the ‘block grant program’) for first episode psychosis activities. Such review shall consider the following:
“(1)
How States use funds for evidence-based treatments and services according to the standard of care for individuals with early serious mental illness and children with a serious emotional disturbance.
“(2)
The percentages of the State funding under the block grant program expended on early serious mental illness and first episode psychosis, and the number of individuals served under such funds.
“(b)

Report and Guidance.—

“(1)

Report .—

Not later than 180 days after the completion of the review under subsection (a), the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions and the Committee on Appropriations of the Senate and the Committee on Energy and Commerce and the Committee on Appropriations of the House of Representatives a report describing—
“(A)
the findings of the review under subsection (a); and
“(B)
any recommendations for changes to the block grant program that would facilitate improved outcomes for individuals with serious mental illness and children with serious emotional disturbance.
“(2)

Guidance .—

Not later than 1 year after the date on which the report is submitted under paragraph (1), the Secretary shall update the guidance provided to States under the block grant program on coordinated specialty care and other evidence-based mental health care services for individuals with serious mental illness and children with a serious emotional disturbance, based on the findings and recommendations of such report.”

Temporary Provisions Regarding Funding

L. 102–408, title III, § 312106 Stat. 2091section 300x–21 of this title, as amended by , , ; , , , provided that, with respect to allotments made for fiscal year 1992 under this part, as in effect on the day before , any portion of the total of such allotments that has not been paid to the States as of the first day of the fourth quarter of such fiscal year be reallotted with the result that the total allotment made for a State for fiscal year 1992 be the amount indicated for the State in a specified table, authorized Secretary of Health and Human Services to make a grant to a State of the reallotment if the State agrees that the grant be subject to all conditions upon which allotments and payments under this part, as in effect on the day before , are made for fiscal 1992, with specified exceptions, permitted transfers of allotments made in fiscal years 1993 and 1994 between this part and subpart II, , under certain circumstances, defined terms as used, and directed funding, subject to a limitation, of a program for pregnant and postpartum women for fiscal year 1993.

Report on Allotment Formula

Section 707 of Pub. L. 102–321section 300x–21 of this title directed Secretary of Health and Human Services to enter into a contract with National Academy of Sciences, or if such Academy declines, with another public or nonprofit private agency, for purpose of conducting a study or studies concerning statutory formulae under which funds made available under this section and are allocated among States and territories, specified findings to be made by the study or studies, directed Secretary to ensure that not later than 6 months after , the study was completed and a report submitted to Committee on Energy and Commerce of House of Representatives and Committee on Labor and Human Resources of Senate, and directed entity preparing the report to consult with Comptroller General with Comptroller General to review the study after its submittal and within three months make appropriate recommendations concerning such report to such committees.
